Understanding New Jersey Driver License Suspension and Revocation
A suspended or revoked driver license in New Jersey means you cannot legally operate a motor vehicle. Understanding the difference between these two terms is important because the path to restoration differs based on which status applies to your situation.

A suspension is a temporary removal of your driving privileges. The New Jersey Motor Vehicle Commission (MVC) sets a specific end date for your suspension when it is issued. Once that period ends, you may be able to restore your license, though additional steps might be required. Suspensions typically range from a few months to several years, depending on the reason for suspension.
A revocation is more serious than a suspension. When your license is revoked, there is no automatic end date. You must take specific actions and meet certain requirements before you can petition for restoration. A revocation often involves more serious violations, such as multiple DUI convictions, accumulating too many points in a short period, or repeated traffic offenses.
Common reasons for suspension in New Jersey include unpaid traffic fines, failure to maintain auto insurance, accumulating 12 or more points on your driving record within two years, DUI or drug-related violations, and failing to appear in traffic court. Other reasons include medical conditions that make driving unsafe, failure to pay child support, and administrative issues like providing false information on your license application.
The New Jersey MVC maintains records of all suspensions and revocations. You can check your license status by contacting the MVC directly or visiting their website. Knowing your specific status—whether suspended or revoked—and the original reason for the action is the first step toward understanding what restoration options may be available to you.
Takeaway: Contact the New Jersey MVC at (609) 292-6500 or check your status online through their official website to confirm whether your license is suspended or revoked and to learn the specific reason for the action.
Reasons for Driver License Suspension in New Jersey
New Jersey suspends driver licenses for many different reasons, and each reason may have different requirements for restoration. Understanding why your license was suspended helps you understand what steps you may need to take.

Point accumulation is one of the most common reasons for suspension. New Jersey uses a point system where traffic violations add points to your driving record. If you receive 12 or more points within two years, your license will be suspended for three months. If you receive 12 or more points within three years, the suspension extends to six months. Violations that add points include speeding, reckless driving, following too closely, improper turns, and failure to yield.
Financial reasons for suspension include unpaid traffic fines and failure to maintain auto insurance. If you do not pay a traffic fine within a certain period, the court may report you to the MVC, resulting in suspension. Similarly, if your auto insurance lapses and the insurance company reports this to the state, your license will be suspended. This is called "lapse of insurance" suspension. To restore your license after a lapse of insurance, you must obtain insurance and provide proof to the MVC.
DUI and drug-related offenses result in automatic license suspension or revocation. A first-time DUI conviction in New Jersey leads to a three-month suspension (for a breath test reading between 0.08% and 0.10%) or seven-month suspension (for a reading above 0.10%). Refusal to submit to a breath or blood test results in a seven-month or longer suspension. Multiple DUI convictions lead to revocation.
Medical suspensions occur when the MVC determines your medical condition makes driving unsafe. Conditions such as severe seizure disorders, certain heart conditions, or vision problems below legal standards can result in suspension. The MVC may request medical documentation or require you to take a medical examination.
Administrative suspensions happen when you fail to provide required documentation, such as proof of insurance, or when you provide false information on your application. Court-ordered suspensions occur when you fail to appear in court, fail to pay child support, or violate other court orders.
Takeaway: Review your suspension notice or contact the MVC to learn the exact reason for your suspension. Different reasons have different paths to restoration, so knowing the specific cause is necessary.
Steps to Restore Your License After a Suspension
Once your suspension period ends or once you complete the requirements for your specific type of suspension, you can begin the restoration process. The exact steps depend on why your license was suspended.

For point-accumulation suspensions, you must wait until the suspension period is complete. Then, you can restore your license by visiting a New Jersey MVC office in person or by mail. You will need to bring your suspension notice and a valid form of identification. You may also need to pay a restoration fee, which is typically around $100. The MVC uses cash, check, money order, or card payment.
For unpaid-fine suspensions, you must pay all outstanding traffic fines before your license can be restored. Contact the traffic court listed on your suspension notice to determine the total amount owed. Once you pay the fine, the court will notify the MVC, and your suspension should be lifted. This may take a few business days to process in the system.
For lapse-of-insurance suspensions, obtain active auto insurance coverage immediately and provide proof to the MVC. Insurance companies can file an SR-22 form or other proof of insurance directly with the state. You may also visit an MVC office with your insurance card or policy documents. A restoration fee is typically required.
For DUI suspensions, you must complete all court-ordered requirements, which may include substance abuse counseling, fines, community service, or installation of an ignition interlock device on your vehicle. The court will tell you what you must complete. Some requirements take several months. Once you complete all requirements, the MVC can restore your license, though you may need to pay a restoration fee.
For medical suspensions, you will need to obtain medical clearance from a licensed physician and submit documentation to the MVC. The MVC may require you to take a driving or vision examination. Once cleared, you can restore your license.
For administrative suspensions related to false information or missing documentation, you must provide the correct information or missing documents to the MVC. This might include corrected proof of residency, proper identification, or corrected personal information.
Takeaway: Before visiting an MVC office, contact the specific court or agency involved in your suspension to learn exactly what you must do and what documents to bring. Preparation prevents delays.
The Process for License Revocation Restoration
Revocation is more complex than suspension. Unlike a suspension with a set end date, revocation requires you to petition the MVC and demonstrate that you meet specific requirements. The restoration process is longer and typically involves more steps.

In New Jersey, you cannot restore a revoked license until a minimum waiting period has passed. For most revocations, this period is one year from the date of revocation. For some DUI-related revocations, the waiting period may be longer—up to five years or more depending on the circumstances. You must check your revocation notice to learn your specific waiting period.
After the waiting period ends, you must submit a formal petition to the MVC. This petition explains why you believe your license should be restored and demonstrates that you have addressed the issues that led to revocation. You will need to include supporting documents, such as proof that you completed required substance abuse treatment, character references, proof of stable employment, and documentation of a clean driving record since the revocation.
The MVC will review your petition and may grant or deny your request. If granted, you will be notified and can schedule an appointment at an MVC office. If denied, you may resubmit a new petition after a waiting period, typically six months. Many people consult with a traffic attorney when preparing a revocation petition to improve their chances of approval.
For DUI-related revocations, the restoration process often requires proof of completion of a substance abuse program recognized by New Jersey. These programs include inpatient treatment, outpatient counseling, or support group participation. The MVC wants evidence that you have addressed the underlying issues that led to the revocation.
Once your petition is approved and you visit the MVC office, you will need to pass a written driving knowledge test, a vision test, and a practical driving test. You must also pay applicable fees, which typically include a restoration fee and fees for the tests themselves.
