What Happens When You Get a Traffic Ticket
A traffic ticket is a citation issued by a police officer or traffic enforcement officer when they believe you have violated a traffic law. According to the National Highway Traffic Safety Administration, over 41 million traffic citations are issued annually in the United States. Understanding what happens immediately after receiving a ticket can help you navigate the process more effectively.

When an officer stops your vehicle, they will typically approach your window and ask for your license, registration, and proof of insurance. They may ask questions about where you were going or whether you know why they stopped you. During this interaction, you have the right to remain silent beyond providing your identification documents. The officer will then write the citation, which documents the alleged violation, the date, time, location, and officer information. You will receive a copy of this citation before the officer leaves.
The citation will include several important pieces of information: the code section you allegedly violated, a description of the violation, and your options for responding. Most tickets include information about whether you can pay the fine by mail, appear in person, or request a court date. The ticket will also show a deadline for responding—typically between 10 and 30 days depending on your jurisdiction.
After receiving a ticket, several outcomes are possible. You may choose to pay the fine, which usually means accepting responsibility for the violation. You may request a trial or hearing where you can contest the ticket. Some jurisdictions offer traffic school or defensive driving courses as an alternative to paying the fine. Understanding these options before your deadline is important because missing the deadline can result in additional penalties, license suspension, or a warrant for your arrest.
Different types of violations carry different weight. A minor speeding ticket is typically classified as an infraction, which is less serious than a misdemeanor traffic offense. More serious violations—such as driving under the influence, reckless driving, or driving with a suspended license—may be classified as misdemeanors or felonies and could result in jail time, substantial fines, or both.
Practical Takeaway: Read your ticket carefully and note the response deadline. Keep your citation in a safe place and do not ignore it. Most jurisdictions allow you to respond in multiple ways, so understanding your options within the timeframe given on the ticket is your first step.
Understanding Different Types of Traffic Violations
Traffic violations fall into several categories, each with different consequences and procedures. Understanding which category your violation falls into helps you know what to expect and what options might be available to you.

Infractions are the most common type of traffic violation. These are typically minor offenses such as speeding under 10 miles per hour over the limit, failing to signal a turn, or expired registration. Infractions are not considered crimes, and you generally cannot be sentenced to jail time for an infraction alone. However, you still have the right to contest an infraction in traffic court. According to traffic court data, approximately 95 percent of traffic citations are infractions. Examples of infractions include parking violations, improper lane changes, broken equipment (such as a non-functioning taillight), and meter violations in cities.
Misdemeanors are more serious than infractions and can result in jail time, typically up to six months or one year depending on the jurisdiction and specific violation. Common traffic misdemeanors include speeding more than 25 miles per hour over the limit, driving with a suspended or revoked license, hit-and-run violations, and reckless driving. Reckless driving is defined differently across states but generally means operating a vehicle with willful or wanton disregard for the safety of others. In many states, a second or third offense for certain violations will be elevated to a misdemeanor. A misdemeanor conviction becomes part of your criminal record.
Felony traffic offenses are the most serious category and can result in significant jail time, substantial fines, and long-term license suspension or revocation. These offenses include driving under the influence with injury or death, habitual traffic offender status (multiple violations within a set period), and vehicular manslaughter. In some states, driving with a suspended license four or more times within a specific timeframe can be charged as a felony.
Point systems are used in most states to track violations. When you receive a traffic citation, points are added to your driving record. The number of points depends on the severity of the violation. For example, speeding might be 2 to 4 points, while reckless driving could be 4 to 6 points. If you accumulate too many points within a specific period (often 12 months), your license may be suspended. The threshold varies by state but commonly ranges from 12 to 15 points. Understanding your state's point system helps you understand the long-term consequences of a violation.
Additionally, some violations are considered "mandatory appearance" offenses, meaning you must appear in court rather than simply paying the fine. These typically include serious violations like driving under the influence, driving with a suspended license, or reckless driving. If your ticket indicates a mandatory appearance requirement, ignoring it can result in additional criminal charges.
Practical Takeaway: Identify whether your violation is an infraction, misdemeanor, or felony by checking your ticket and reviewing your state's traffic law. This classification determines your available options and potential consequences. Look for the statute or code number on your ticket and research what category it falls under.
How to Read and Understand Your Traffic Ticket
Your traffic ticket contains critical information that you need to understand before deciding how to respond. Taking time to carefully read and interpret each section of your ticket helps you make informed decisions about your case.

The citation header typically includes your name, address, driver's license number, date of birth, and the officer's name and badge number. Verify that your personal information is correct. Any errors in your name, address, or license number should be noted, as these errors may be relevant if you contest the ticket. The date, time, and location of the alleged violation are also listed in this section. Check that the location is accurate—if you were cited in the wrong location, this could affect the validity of the ticket.
The violation section states the specific traffic law or code you allegedly violated. This will be listed as a statute number or municipal code reference. For example, a ticket might read "Vehicle Code Section 22349(a)" which typically relates to exceeding the speed limit. The description of the violation will explain what you allegedly did—for instance, "Speeding 48 mph in a 35 mph zone." Write down the exact violation code and description. You will need this information if you decide to research the law or appear in court. The violation code tells you the severity of the offense and helps you understand what law you allegedly violated.
The officer's narrative section may include details about the stop, such as why you were pulled over or what the officer observed. Not all tickets include extensive narrative details. If the narrative is vague or doesn't match what you remember happening, this discrepancy could be important if you contest the ticket. Some officers provide minimal information, simply stating the code violated and your speed or other measurement.
The fine amount is listed on your ticket, though the exact amount may vary based on your jurisdiction's penalty schedule. The fine is often the base penalty, and additional court costs or assessment fees may be added. Some jurisdictions allow you to pay by mail, and the ticket will include payment instructions and a due date. Do not miss this deadline. The ticket will also indicate whether you have the option to attend traffic school or defensive driving courses, which may allow you to avoid a conviction being recorded on your permanent record.
Your options for responding are typically listed at the bottom of the ticket. Common options include: paying the fine (admitting guilt), requesting a trial or hearing (contesting the ticket), or requesting traffic school (if available). The ticket should specify how to exercise each option and the deadline for doing so. Read these instructions carefully, as missing a deadline can result in additional penalties.
Finally, check whether the ticket indicates a "mandatory appearance" requirement. If it does, you cannot simply pay the fine by mail; you must appear in person at a court date specified on the ticket or request to reschedule that appearance.
Practical Takeaway: Make a copy of your ticket and highlight or circle the violation code, description, amount owed, and deadline. Create a simple checklist noting the date the ticket was issued and the date by which you must respond. This helps you stay organized and ensures you meet all deadlines.
