What Is a Fake Social Security Number and Why It Matters
A fake Social Security Number (SSN) is any nine-digit number that does not belong to you or was not issued to you by the Social Security Administration (SSA). This includes numbers you create yourself, numbers you obtain from another person, numbers that were never issued, or numbers issued to someone else. Understanding what constitutes a fake SSN is important because using one—whether intentionally or unintentionally—can result in serious legal consequences.

The Social Security Number system was established in 1935 as part of the New Deal. Today, SSNs serve as the primary identifier for financial and legal transactions in the United States. Every legitimate SSN follows a specific format and numbering system established by the SSA. Not all nine-digit combinations are valid SSNs. For example, numbers beginning with 000, 666, or in the 900-999 range are never issued. Numbers with 00 in the middle section (area number) or 0000 in the final section (serial number) are also invalid.
People use fake SSNs for various reasons. Some create them thinking no one will notice. Others receive numbers from employers or individuals who may have told them these numbers were legitimate. Immigrants sometimes use fake SSNs to work or open bank accounts before obtaining legal status. Students or young adults might use fake numbers to get credit cards or loans. Regardless of the reason, federal law treats the use of a fake SSN as a serious offense.
The consequences of using a fake SSN extend far beyond immediate legal trouble. A single instance of SSN fraud can affect your employment history, credit record, ability to borrow money, housing options, and professional licenses. Financial institutions report SSN mismatches to government agencies. Law enforcement agencies actively investigate SSN fraud cases. The impact can follow you for years, even after you stop using the fake number.
Practical Takeaway: If you suspect you are using or have used a fake Social Security Number, understanding what makes a number fake is the first step toward addressing the problem. A real SSN is one issued directly to you by the Social Security Administration, documented in their records under your legal name, and associated with your official work history and tax records.
Criminal Penalties for Using a Fake Social Security Number
Using a fake Social Security Number is a federal crime in the United States. The primary law that addresses this offense is Title 42 of the United States Code, Section 408(f), which makes it illegal to use a SSN that is not your own. This statute applies whether you created the number yourself, used someone else's number, or obtained a fraudulent number from another source. The law does not require that you intended to defraud anyone—simply using a SSN that is not rightfully yours can result in criminal charges.

Federal law also covers related crimes. Under Title 18, United States Code, Section 1028, creating, using, or possessing fraudulent identity documents—including fake SSNs—is illegal. This statute carries penalties of up to 15 years in federal prison and fines up to $250,000. Additional charges may apply if the fake SSN was used to commit other crimes, such as identity theft, fraud, or money laundering. Prosecutors often bring multiple charges in SSN fraud cases, which can result in consecutive sentences that add up to decades of imprisonment.
The penalties for SSN fraud are substantial. A first-time offense of using a fake SSN typically results in fines ranging from $250 to $5,000 and imprisonment for up to five years. If the fraud involved obtaining government benefits, such as Social Security payments, Medicare, or unemployment insurance, the penalties increase. Obtaining benefits through SSN fraud can result in fines up to $20,000 and imprisonment up to 10 years. If the case involves identity theft or use of another person's SSN, sentences are often longer.
In practice, federal prosecutors have substantial discretion in how they handle these cases. Some cases are prosecuted aggressively, particularly when large amounts of money or multiple victims are involved. Other cases may result in plea agreements where defendants accept reduced charges in exchange for guilty pleas. However, even with plea agreements, prison time is common. According to federal sentencing guidelines, judges consider factors such as the defendant's criminal history, the amount of money involved, whether the defendant acted alone or with others, and whether the defendant has already made restitution.
Practical Takeaway: SSN fraud is prosecuted as a federal crime, which means cases are handled by federal courts with mandatory minimum sentences in many circumstances. If you are facing potential charges related to SSN fraud, understanding the specific laws involved and consulting with a qualified attorney is essential, as federal prosecutions are complex and carry serious consequences.
Civil Penalties and Financial Consequences
Beyond criminal punishment, using a fake Social Security Number creates significant civil liability. Civil penalties are financial punishments imposed by courts or government agencies separate from criminal penalties. For SSN fraud related to government benefits, the Social Security Administration can demand repayment of all fraudulently obtained benefits plus penalties. These repayment amounts can exceed tens of thousands of dollars, depending on how long the fraud continued and how much was paid out.

The IRS imposes additional civil penalties for SSN fraud related to tax matters. If you filed tax returns using a fake SSN or if someone used your SSN to file fraudulent tax returns, the IRS can assess civil fraud penalties equal to 75% of the underpayment of taxes caused by the fraud. For example, if $10,000 in fraudulent income was reported, the penalty could be $7,500 in addition to back taxes and interest. These penalties compound over time due to interest, which accrues at a federal rate that changes quarterly. After several years, civil penalties can double or triple the original amount owed.
Employers face significant penalties for knowingly hiring workers with fake SSNs. Under the Immigration Reform and Control Act, employers can face civil penalties ranging from $100 to $1,000 per employee for each violation. Additionally, employers can be liable if they negligently fail to verify the authenticity of SSNs provided by employees. If an employee used a fake SSN and caused financial harm to the employer or to customers, the employer may have grounds to sue the employee for recovery.
Your personal credit and financial standing suffer substantially from SSN fraud. Credit bureaus receive reports of SSN mismatches when numbers do not match employment records or Social Security Administration records. This creates discrepancies in your credit file that can prevent you from obtaining loans, credit cards, mortgages, or auto loans. Even after criminal charges are resolved, these financial consequences persist. Rebuilding credit after SSN fraud typically takes 7 to 10 years. During this period, interest rates on available credit are significantly higher, and many financial products are simply unavailable.
Practical Takeaway: SSN fraud creates financial obligations that can exceed $100,000 or more when combining repayment demands, penalties, interest, and back taxes. These civil consequences often last longer than criminal sentences, continuing to impact your finances years after any criminal case concludes.
Immigration and Employment Consequences
For immigrants and non-citizens, using a fake Social Security Number has severe consequences related to immigration status. Federal immigration law considers SSN fraud a crime of moral turpitude, which means it can result in deportation even if the person has been lawfully present in the United States. Someone with a green card (permanent resident status) who is convicted of SSN fraud can lose their status and be deported. Someone on a work visa can have their visa cancelled and be required to leave the country.

Using a fake SSN can also permanently bar someone from future immigration benefits. If someone hopes to eventually gain citizenship or obtain a green card, a conviction or admission of SSN fraud makes this impossible in most cases. U.S. Citizenship and Immigration Services (USCIS) considers SSN fraud fraud against the U.S. government, and immigration law contains provisions that permanently deny benefits to anyone convicted of fraud. This means someone who used a fake SSN years ago may discover, when applying for a visa or green card later, that they are ineligible because of that past conduct.
In employment situations, using a fake SSN can result in immediate termination. Employers are required by law to verify that SSNs match Social Security Administration records. If a mismatch is discovered, employers must notify the employee and the Department of Homeland Security. The employee is then placed on a list and cannot legally work in the United States. Even if an employer does not immediately terminate the employee, the employee's work status becomes ineligible
